The U.S. Trustee's Manual for Chapter 7 Trustees instructs trustees to seek disgorgement of the portion of your retainer fee that is unused as of the date of filing the bankruptcy, because such funds are property of the estate. The U.S. Supreme Court has ruled that a consumer bankruptcy debtor cannot be paid out of property of the estate. In another case the Supreme Court held that any unpaid balance as of date of filing is discharged in the bankruptcy. So, are you supposed to provide services free of charge?
